Chief Justice Abdul Hamid Pointer for Ponder



Lord Justice Abdul Hamid said the move that amended Article 121(1) was made in anger as a reaction to a decision of the court in the case of PP v Yap Peng where the A-G transfered a criminal case to another court at his discretion and the Supreme Court held that was an encroachment on the judicial power of the courts. Thus Article 121(1) was amended to redefine judicial powers and the judges became lame ducks, or, what they say, "The President's Men".

Did the executive conspired with the Attorney-general's office? Or, was the A-G the stuntman of the President?

This illustrate the extend of kow-towing during the M dynasty. I think Pak Lah at least deserves some credit for appointing a Law Minister with strong legal background, not to mention outspoken, who carried on Pak Lah's promise of judiciary reform immediately after he came into office. It is not disputed that the AG serves the government, so a strong judiciary is very important to ensure checks and balance -- something virtually non-existent during the M dynasty. Funny now Dr M is throwing stones at the credibility of Zaid to be a minister..he takes the glass house cliche to a whole new level, apparently he forgot how he said he has "saved Rafidah 3 times" during the AP issue. Saving her from WHAT, exactly?

Another legacy of Dr M - an almost crippled judiciary system. More than that, Dr M's people are still within UMNO now, and they are preventing the reform initiatives by Pak Lah and Zaid from taking a robust step forward.

Mr Anon, I no longer live in an artificial economic bubble. And I also think about sustainable development, the future and the need for our country to be able to compete globally, which is the only way to progress. Incidentally, since recognising the bubble for what it is, I buckle up and a direct answer to ur question is, I'm doing better now. MUCH better.

I tend to agree with you that Pak Lah is slightly better; but the Altantunya revelations and his insistence of the innocence of his assistant is unacceptable as what is important is that as a PM he should get the AG and the police to investigate the accusations. And another thing is, the judicial reforms is talk only thus far.
