PKR wants racism & kleptocraticism erased

A Kedah delegate to the PKR Youth congress called on members of the wing to live up to their to multiracial tag and eliminate racism in themselves.

Khairul Nizam Mohd Razali, from Padang Serai, said he had been raised since childhood with all sorts of stereotypes and presumptions about other ethnic communities.

Among these was the belief that the Chinese store weapons in their houses and, therefore, pose danger to the security and safety of the Malays, he said.

He was also told that when a Chinese dies, his or her identity card is kept so that it can be taken up by a migrant from mainland China, who are “coming in droves to seize this country away from us”.

However, Khairul said his involvement in the reformasi movement and activism with PKR members and activists from other ethnic communities have allowed him to see that such notions are false.

He said these falsehoods were created and perpetuated by Umno and Barisan Nasional’s other component parties in order to keep the communities divided and distrustful of each other.

“This is among the political games of Umno and BN to scare Malays. They give us sweeping statements about other communities. But what have they done for us? What have they given to us up until now?

“They have given us only propaganda. The MCA would tell the Chinese that if they enter PAS, they have to be circumcised.

"Indians are told that if they join the opposition parties, they cannot drink alcohol.”

Urging party members of all races to confront these and other myths and erase them from their minds, Khairul said: “If we do not do this, how can we expect the people behind us to do so? If we can do this, then the whole country will fall to us.”

About 600 Youth delegates responded with shouts of approval and applause.

Meanwhile, PKR Youth has urged the leaders of the five Pakatan Rakyat-led states to honour the opposition front’s election pledge to get rid of ‘Barisan Nasional elements’ in their administration.

“The people want us to have a total clean-out to eliminate the influence and corrupt practice of BN-Umno in the states,” Youth chief Shamsul Iskandar Md Akin said.

“PKR Youth reminds the Pakatan state governments not to waver or to cite 1,001 excuses. The ‘clean-out’ of BN elements must be done without any delay.”

Sept 16 press statement in full

The following is the statement given by Opposition Leader Anwar Ibrahim at a 2pm press conference at the PKR headquarters in Petaling Jaya today:


Today, Malaysians celebrate Malaysia Day - the day our country became whole and our people become united. This day has a new meaning.

After years of struggle, after fighting against a system that is corrupt and unjust - we affirm that victory is finally at hand. Our vision of rebuilding this country and bringing its people together, as the founding fathers envisioned, is within reach.

The economy is in turmoil with runaway inflation and joblessness creating widespread discontent. Racial tensions have been rising, exacerbated by the propaganda spread in the government owned mainstream media. The administration has offered no vision to steer the nation out of this quagmire and there is manifest erosion in confidence in the current government.

We in Pakatan Rakyat believe we can save Malaysia from economic ruin and the dangerous politics of racism. We will do so prudently, legally and in doing so we will not jeopardise the security and stability of the country and the safety of its people.

We have received firm commitments from members of parliament in excess of the number required to form a new government, and our government will reflect the diverse make-up of Malaysian society. 

It has been our concern to ensure a peaceful transition of power. We do not wish to see a repeat of what transpired in the Selangor and Perak state governments, where following the victory of Pakatan Rakyat on March 8, documents were shredded and removed by the outgoing administration.

We furthermore advise radical elements within BN against the abuse of state power to unlawfully harass and detain our supporters.

The immediate investigation by the ACA (Anti-Corruption Agency) of Yong Teck Lee after the announcement by SAPP (Sabah Progressive Party) of its intention to move a motion of no-confidence against Abdullah Ahmad Badawi is another example of the tactics we reject.

The use of the ISA, as has happened to MP Teresa Kok, would be an unlawful impediment to the transition process.

In light these serious concerns, yesterday leaders of Pakatan Rakyat sent a letter to the prime minister at 2.30pm requesting a meeting to discuss the future course of the nation's leadership and to seek his assurance on the following important matters:

1) That the BN shall not hinder or prevent their BN MPs from acting in accordance with their conscience, constitutional rights and independent judgment;

2) That the BN government shall not invoke the Internal Security Act to detain any of the MPs who will join Pakatan Rakyat, or any of the present 82 Pakatan Rakyat MPs;

3) That the BN government shall not invoke emergency or police powers, or suspend the constitution, or dissolve parliament in response to our intention to form a new government;

4) That the Barisan Nasional government shall not impose roadblocks and impede the MPs from gaining access to the House of Parliament and the institutions of government.

We believe the prime minister will share Pakatan Rakyat's concerns for the welfare of the people and security of the nation. We are confident he will ensure the BN will act constitutionally and democratically to ensure that the transition will be peaceful, and there will be no actions taken to sabotage the wishes of the people or play on racial tensions in the country.

We appeal to all quarters in Malaysian society to understand our intentions are for the betterment of Malaysian society. The mainstream media, in particular, should accept the reality of these historic times and report fairly, accurately and without bias. The irresponsible tact that is used by the media to obfuscate issues, attack opposition supporters and instigate racial tensions must end immediately.

Following our meeting with the prime minister, we intend to proceed within the framework established by the federal constitution in the formation of a new government, with the assent of the Yang di-Pertuan Agong.

NOTE:

AFP quoted PAS treasurer Dr Hatta Ramli as having said that the opposition coalition would seek an audience with the king to seek a mandate to rule, should Abdullah reject the request for a meeting.

“The issue of the appointment of the prime minister and change of government is very much the role of the king,” Hatta said.

He claimed that the opposition now has the support of as many as 116 parliamentarians. This would mean 35 government defectors.

Opposition Leader Anwar Ibrahim insisted he has in excess of 31 government defectors and call on Prime Minister Abdullah Ahmad Badawi not to implement emergency rule during the takeover.

At a packed press conference at 2pm today, he urged the ruling Barisan Nasional to commit to a peaceful handover of the government and not resort to emergency rule.

“We want a peaceful transition. We hope that Barisan will not put up emergency rule to stop MPs from going to Parliament or arrest (government) MPs or stop them from joining Pakatan Rakyat,” he said.

He has sought a meeting with Abdullah to show him the list of names of defectors and to discuss a smooth handover.

Anwar will need at least 31 defectors from BN and perhaps over 40 to form a stable Pakatan Rakyat government.

Perak PR celebrates Merdeka

Pakatan Rakyat government of Perak celebrated Merdeka today.

The PR state government is still intact and had not collapsed as predicted. by former BN Menteri Besar Tajol Rosli Ghazali who promised that the Barisan Nasional government would dethrone the present Pakatan Rakyat govt and take control of the state. Ezam had also concurred with Tajol Rosli and both of them had work so hard to get a few state assemblymen arrested for alleged corruption, probably because they refused to crosssover.

BN knows how to woe over the assemblymen from PKR and including those from PAS. Those PKR were, after all, former Umno members and they had the same characteristics and behaviors and shared the same culture and values of Umno: they can be bought with money. - money, irrespective of God which is needed only when specific objectives are to be met. We do not know why these these PKR ADUNs did not bite the BN money-bait; instead, they claimed they were setup by the ACA-inspired Umno demagogues. We don't know, but old habits are calcified within: 'xiang san yi kai, peng sing nan yi.'

One thing is for certain: BN can never buy over those Chinese stateassemblymen from DAP; they are hardcore DAP cadres and they have self-integrity; they love money but they would earned it. They have not acquired the culture of corruption and bribery, as yet; they were part of the long traditional culture of paying, paying to those in Umno and MCA, and little napoleons.

Now, we will wait for September 16 to see if Anwar and Tajol Rosli are both liars.

Nalla paid RM60mil to Anwar of Umno

NST Report Today:

Datuk S. Nallakaruppan is set to expose all on Parti Keadilan Rakyat's de facto leader Datuk Seri Anwar Ibrahim in court.

"I have five CDs and other evidence to tell Malaysia who Anwar is."

He said his wife had called to say that he had received a legal notice on his statement about Anwar on Sunday.

Bernama reported yesterday that Nallakaruppan claimed he had handed over RM60 million to Anwar, which he alleged had come from Magnum Corporation.

Why did Nalla pay so much to Anwar in the 1990s?

Did he give the money to Anwar as a friend, to help a friend, or to bribe a deputy prime minister? If it is bribe, then why didn't he report to ACA then? Under the law, a person who pay bribe is guilty of corruption, and a person who accepts bribe is also guilty. Nalla must surely know that what he was doing was illegal and wrongful in law.

If he was innocent then, he should, by the rule of law, have reported the matter to ACA; but it seems he didn't. Then, the question of his motive and intention to pay such a big sum of money to an Umno deputy president and who was also the then deputy prime minister, comes to be probed. He must now provide the answers this mystery.

Nalla is also a religious and pious person. I wonder whether he would swear at the temple or cut the cock's head

This is the advice given by former Perak MB who is also the Perak Umno Liaison Committee chairman Datuk Seri Tajol Rosli Ghazali:

"He can swear according to his belief. Maybe, if he is a Christian he can swear accordingly or if he wants to do it the Chinese way then he can potong ayam (slaughter a chicken) at a temple.

"But, if he is going to slaughter the chicken then I want Perak MCA organising secretary Dr Mah Hang Soon, state Gerakan chief Datuk Chang Ko Youn and state PPP chairman Datuk Lee Heng to bear witness to [the] swearing."

Nowadays, swearing is the new fashion to declare and proof innocence. The courts will soon be redundant and obsolete. Muslims can swear by the Quran, Christians can swear by the Bible, Chinese can potong ayam and the Hindus, they can swear at either the Hindu temples or Chinese Temples.

The season of swearing was extended today when 20 BN parliamentarians followed the trend.

At a hotel in Seberang Jaya this afternoon, Barisan Nasional Youth chief Hishammuddin Hussein led the MPs in an oath-taking ceremony.

Hishammuddin, who is also the education minister, said the pledge was a sign of loyalty to the BN alliance.

"We sign the declaration and swore to remain loyal to Barisan Nasional. This is black and white proof to counter rumours that we will leave BN for another party," said the Umno Youth chief.

Hishammuddin urged the BN supporters to behave themselves as the whole world will be watching them.

Should Statutory Declaration be banned immediately or made illegal?

Another Statutory Declaration made ...aiyo, what has happen to our country?

Malaysia-Today reported that: [quote] "Thagarajoo a/l Thangavellu swore through a Statutory Declaration, that Najib and his wife, who may be born Muslims, are practicing Hindus." [unquote]

Tangarajoo, a former driver for Datuk K.S. Nallakaruppan, in his statutory declaration also revealed that in 1998 there was a conspiracy to implicate Anwar in sex scandals with various women

Why has people got to resort to Statutory Declaration? Why can't they go make police report or file a complain with the ACA? or, tell the parliamentarians so that the scandals can be debated in parliament?

Is it because of the lack of integrity or the presence of distrust towards to a system administration?

Maybe, the present government may have to consider to review the laws relating to statutory declaration and make it illegal to make sworn statement against "credible" & "Powerful" personalities. Why can't they trust the police and the ACA and the courts? Why can't we have a government whom people can be confident to expose those scandals?

Are these people lying?

Or, are we now hearing of the truth that could and would not have been exposed if Mahathir is still PM? Or, was it because Mahathir had managed the country and the people so well that they would not speak of such "evils" or would not have allowed such scandalous news a chance to be made public?

I wonder! I ponder!

Anwar bisexual?

It's news! A new accusation from Umno. They accused him of sodomy. Now they are accusing him of womanising. That's bisexual characteristics.

Deputy Housing and Local Government Minister Hamzah Zainuddin accused Anwar of making a move on his wife.

I wonder if Hamzah would also go to the Federal territory Imam to swear.

Hamzah had been quoted in the Kwong Wah Jit Poh newspaper as saying that Anwar had in 1998 tried to take advantage of his wife even though they were best of friends then.

He told the newspaper that Anwar had "kacau" his wife.

In view of this, the deputy minister told the daily that the people of Permatang Pauh should not vote for the opposition leader.

According to Anwar's lawyer, Hamzah's words have "(1) directly and/or indirectly and/or by innuendo, given an impression and the perception that Anwar is engaged in illicit sexual activities and/or habitually engages in similar activities, (2) is a man of low morals; (3) is a man of no Islamic values and (4) is of bad character."

Anwar has demanded an apology from Hamzah or face a RM10 million lawsuit.

Hamzah, who is former state agency Felcra chief, was embroiled in a sensational divorce settlement in 2004 where he was ordered by the Perak Syariah Court to pay his ex-wife, Nooraini Abdul Rashid, a whopping RM11.2 million in cash and assets.

The judge also ordered Hamzah to transfer one-third of his 63 million shares to Nooraini or pay her RM10 million.

Nooraini brought the suit after Hamzah divorced her in 1996. Hamzah has since re-married and it was his new wife who was allegedly harrassed by Anwar.

Hahahaha... Anwar is not a backside king. Umno members are now accusing him of womanizing. Womanizing is possible because he has so many children.

Would we also hear from other MPs and Umno leaders that their wives have slept with Anwar too?

Before 1998 Anwar is a powerful man. Umno leaders and members were working hard to rub his shoulders and balls, and probably the dick too. Now we have come to know that they were even prepared to loan their wives in exchange for favors from Anwar. But I think their wives are not so stupid to betray their own conscience. But we don't know!

Distress & the "Evil" Bloggers.

Prime Minister Datuk Seri Abdullah Ahmad Badawi has described the action of a blogger in calling on his blogsite followers to fly the national flag upside down as a sign of protest as evil.

He said flying the Jalur Gemilang upside down could not be regarded as an act of mischief alone but a despicable one.

Abdullah hoped the police would act on the matter.

Anyway, coming back to the upside down flag thing; I'm not sure how it can be evil. I didn't fly it that way; so he is not directing his anger at me. So, I'm not despicable nor disrespectful to him.

Was flying the flag upside down wrong and unlawful? I don't think so; as this is universally accorded as an act to show that a nation is in distress.

I agree with Kickdefella that Malaysia is truly in distress. In what way did I affirmed my opinion?

The cost of living had reached a state of distress. Not me, I can afford another fuel hike of RM0.78. I am a crony, so I'm okay. But millions of Malaysians are feeling the distress; they are struggling to make ends meet and we have a prime minister and a deputy prime minister who responded to our plights by telling the people to "Ubah Gaya Hidup." But their gaya hidup is already rock bottom and their debts due to inflation and rising costs are multiplying. Many are crying: "Macam mana nak ubah lagi? Jual ponggong? Jual darah? Tak da nak ubah lagi. Installment kereta dan rumah dah banyak bulan tak bayar; periuk nasi pun dah kosong; apa lagi nak ubah? selipa dan selimut pun dah gadai."

If the fuel hike isn't bad enough, dear PM, please asked Jeanne to go to the sundry shops and supermarket to check the price of rice, cooking oil, canned food and all other essential goods; the prices had shot up more than 50% and continually inflating. To add more distress, while income are diminishing fast we are further told that the water tariffs and electricity tariffs are rising. Toll rates may be adjusted too.

That's not distressful enough? Well, I could not comprehend how a prime minister could have pronounced that a backside player who had allowed himself to be screwed 8 times without complain, for whatever reason, could be called a victim of abuse and the prime minister had repeatedly said that the law must accord justice to him. If ever the law said that sodomy is unlawful, both players who had spent eight occasions of pleasure must be indicted and charged; it can't be only one. And how is it that a PM who carved the Islam Hadhari explains his controversial moral philosophy with regards to these two Muslims? I am perplexed and distressed by his reasons which is beyond any logical or moral comprehension.

Nurin is dead and that murderer is still at large. Sharlinie has yet to be found. Altantunya's case are getting muddied each passing day, and Balasubramaniam and Dr Mohamed had gone hiding. There's more than four Statutory Declarations made and such instruments are meant to be effective, not subjective. And the police are busy with protecting Saiful and Mat Rempits at Permatang Pauh, while at the same time they are now called to attend to "Evil" bloggers. But the murderers and criminals are out there smiling and planning new jobs. And the steel gratings and drain gratings on the roads and drains had vanished. The burglars could be coming to all homes to collect all the steel and iron gates. We can't ruled out that they would not take the gates at Putrajaya and Istana too.

Aren't we in distress?

I can understand the dilemma and distress the prime minister is going through. He is also busy fighting for his own political survival. His own party members wants him to retire. His deputy is also working hard to allow it to happen while at the same time being empathetic towards him.

Anwar is also giving a lot of problem to him; Anwar keeps telling and professing September 16 and this is surely stressful and causing sleepless nights for our PM (but he still sleeps because he is too tired).

Umno's convention is in December and there's much internal disorders within Umno. Mahathir had been consistent in his call for the PM to step down and Mahathir is still popular and influential.

Recession is arriving and should it reached our shores it could be devastating. The price of food stuff keeps rising; fortunately, crude price is coming down.

Sabah BN partners are giving our PM a hard time. Sarawak keeps inviting PM and DPM over for functions and at each function a billion Ringgit federal development fundings must be pledged. But where to find so much money needed? And BN has still owes RM218mil for election materials since 2004.

It must be extremely stressful, distressful and agonizing for our PM. Many PM in such distressing situation would have been warded into the psychiatric chambers and certifed mad. Fortunately, our PM can still tahan because he has sufficient sleep. But Raja Petra has been causing him consistent nightmares. RPK has intermittently reveals enigmas and progressively reveals new mystics and caused him much miseries.

So, I've decided not to fly the Jalur Gemilang upside down because I do not want to add to the mammoth agonies and miseries of our dear PM. Let's pray for our PM who is suffering psychiatric pains resembling raging infernos. The distress can possibly drive him insane, or, if not, it may drive him to suffer from insane delusion.

Let's pray for our PM and DPM, and let's also pray that the ghost of Altantunya will not disturb him nor disturb his close aide. This is the 7th Chinese calendar month which the Chinese believed is the month when the ghosts go roaming around earth. The Chinese must help burn more incense and hell notes to Altantunya, Nurin and many others whose souls had not reached heaven's gate as yet. Their spirit may still be on earth and we need to take care of them.

Dear PM, I fly the flag for our nation.

Merdeka! Merdeka! Merdeka!

But the true Merdeka is the day when all Malaysians respect each other as Bangsa Malaysia.

Saiful swears. Anwar shit!

Saiful told reporters that he had waited to garner courage before swearing on the Quran. Earlier, Saiful swore on the Quran at the FT mosque in Jalan Duta that he was sodomised by Anwar.

Below is the statement read out by Saiful:

I feel that the time is right for me to do my duty as a Muslim and Malaysian by doing what is right. With this, I swore in the name of Allah at the Federal Territory Mosque this evening in accordance to the teachings of Islam and as advised by religious scholars and teachers that I was sodomised by Anwar Ibrahim.

The oath I've taken was done voluntarily and it was done to uphold the truth as a Muslim, a Malay and a Malaysian.

I understand that if the allegations and oath that I've taken under the name of Allah are not true, I will be cursed by God and tragedy and curse will come upon my family and the generations after me forever.

I've taken this oath to prove that my allegations are completely true. This is the best way for me to attain justice in the world and the hereafter and for me to redeem my pride and dignity as Allah is the only place where I can complain to.

I've done this for God and I took my oath in the house of God, that I was humiliated and sodomised by Anwar Ibrahim and I do not wish to lie to the world as he has done.

With this, I challenge Anwar Ibrahim to swear by Islam and do it in a mosque, witnessed by religious scholars, teachers and all Malaysians to deny what I've accused him of.

Below are the questions posed to Saiful and his answers:

Who witnessed the oath-taking at the mosque?

Saiful's lawyer Zamri: All the FT Mosque imams.

Where have you been hiding all this time?

Saiful: I've not been hiding but I was quietly gathering enough courage to answer all the allegations against me, especially by Anwar Ibrahim.

Why did you pick today and the FT Mosque?

I've been intending to do this for some time now but it needs mental and spiritual strength as taking an oath is not something trivial or easy. The consequences can be very dire in the eyes of God. Nevertheless, Allah has given me the strength to take the oath today.

I feel relieved and for the first time, I feel that I've been given the strength by Allah to face reporters.

Puzzled? Perplexed? Ya, I'm!

I ponder: He said he felt today was the right time to do his duty as a Muslim after 2 months by doing what is right? So, what was right thing to do? Swear on the Quran was the right thing to do? I do agree. But then, would it be taken to mean that the earlier meeting with Najib, Dr Mohamed and negotiating with a police officer and ultimately making a police report was in itself never the right thing? If he wants to do his duty he should in the first place had sworn by the Quran and thereon leave it to Allah to punish Anwar. But he is so passionate to want so much publicity and gaining compassion. By his own words, "it is between him and anwar and Allah"; if that is so, then why he wants so much publicity to proof that his arse was on the line of fire? I am puzzled and perplexed!

Saiful said: [quote]"He swore in the name of Allah and in accordance to the teachings of Islam and as advised by religious scholars and teachers that I was sodomised by Anwar Ibrahim." [unquote]

Ponder: There seems to be a catch - did he say that he was advised by religious scholars and teachers that he was sodomized by Anwar? He was advised to swear that he was sodomized? Or he was advised that he need to swear? And he said it was done in accordance with the teaching of Islam? Tell me in which Surah gave such teachings on swearing? I have not found a phrase in the Quran pertaining to swearing as an victim; the victim was suppose to get the necessary witnesses as espoused; that's the rule of syariah.

Saiful said: [quote] "I've taken this oath to prove that my allegations are completely true. Allah is the only place where I can complain to." [unquote]

Ponder: If Allah is the ONLY place to complain, then why did he go everywhere, including to Najib to complain. Najib is not Allah! And he don't have to take an oath to prove that his allegation is completely true. If the sodomy is true, Allah surely knows; the Quran said Allah knows everything; so you don't need to prove to Allah that you did not lie. If you believe in Allah, you must also believed that Allah is all knowing and Allah is omnipotent and omnipresent.

And Saiful also said: [quote] "I've done this for God ... and I do not wish to lie to the world as he [Anwar] has done." [unquote]

Ehm!!! You did this for God? Oh my God! You can't be doing this for God; you are doing this for yourself and to convinced us human beings that you did not lie; you don't do this swearing for God and God do not need you to do this for Him.

Saiful said [quote]: "I've not been hiding but I was quietly gathering enough courage to answer all the allegations against me, especially by Anwar Ibrahim. It needs mental and spiritual strength as taking an oath is not something trivial or easy. The consequences can be very dire in the eyes of God. Nevertheless, Allah has given me the strength to take the oath today." [unquote]

Ponder: Why do he need mental and spiritual courage to tell God? If you believed that God is all knowing, it must mean that He already knows whether you tell Him or not. Of course the consequences of falsely swearing to God is dire in the eyes of God. But if the sodomy was a factual act committed, he never need to fear about telling this truth to God because he already knows that God knows of what had happened to his arse. I don't need strength to tell God because I know that God is omnipotent and omnipresent irrespective whether I tell Him or not.

Ponder: This certainly is a private matter between 2 person and God alone. Saiful is right on this. But then he chose to go to Najib for advice; Najib was the first to know. After that, he then went to some specific police officer for advice at a hotel room to discuss the sodomy; thereafter, he went to so Dr Mohamed and then to HKL before he went to make a police report. By involving so many parties it was no more a private matter; it has become a public issue.

It must have been a great courage for him to come out now to meet the press after the swearing. The swearing was suppose to be a private matter; but he went to the press to pronounce the swearing for reasons known only to himself and his lawyer.

Now, it's Anwar's turn to do so. He has to do it; otherwise things will turn against him.

Anwar said if Saiful wants to adopt the Islamic method then he should follow the syariah way and make his complain there instead of going to the police.

"I too have already referred this case to the Syariah Court and the officers there want to take his statement but the police have stopped them. Saiful is under police protection and they have a hold on him and they decide what he should or should not do," said Anwar.

Saiful said it was a coincidence that he was making this revelations one day before the nominations for the by-election. It surely is coincidental!

Saiful thank Allah for Justice done

Saiful thankful Anwar finally brought to justice

Mohd Saiful Bukhari Azlan is thankful to Allah that Datuk Seri Anwar Ibrahim will finally be brought to face justice.


Saiful also hopes that all Malaysians will pray that the legal process is carried out smoothly so the truth can be proven in a just manner,” he said yesterday.

I am perplexed and puzzled! Anwar is charged for consensual sex and Saiful thank Allah that his consensual partner in the sexual act had now being charged in the court. If it is consensual, does it mean that Allah is granting Saiful justice? I am perplexed and confused!

Dear Malaysian, Saiful ask all of you to pray that the legal process is carried out smoothly so that the truth can be proven in a just manner. I don't really understand what he means; but I presumed that if two parties had agreed to have anal sex, I can't configure what kind of justice is Just and Fair and can be carried out smoothly in order to convict one party to an unlawful act; it must mean that both parties who had consented to an unlawful act are both guilty of the same crime.

Could a prostitute (who is above 18 years of age) who accepted and agreed to have sex with a customer and then received payment for the service provided later make a police report and claim that the customer had rape and paid her for the sexual act for which she had earlier agreed to perform? Prostitution is a unlawful act; but based on the above analogy, the customer can be charged for rape although it is unclear whether the police would have acted saifully.

Prime Minister Abdullah said that the police were duty bound to charge Anwar because they had to protect the rights of Anwar’s accuser Mohd Saiful Bukhari Azlan.

“Don’t forget that there is another person, Saiful. You seem to forget Saiful and you think Anwar is more important. This is the issue of the law,” he said.

On whether Saiful would also be charged if he was a willing partner, Pak Lah said:

“You better read your law. If there is rape the accused will have to face action. This is a matter for the law. But I am not lawyer and I won’t get involved. We’ll see what happens in court.”

Dear PM, I read law and I understand law. But the charge is consensual sex, not rape, sir?

Dear PM, I know you are not a lawyer, but you have many advisers who would have briefed you on the aspects of the law. In consensual sex, both party consent to have the sexual acts and both agreed to have the fun.

I have read your statement earlier in which you said Saiful must be given justice based on the rule of law.

This is what you said, dear PM,and it was published on 2 Aug 2008 NST Prime News page 8:

“We must remember that the complainant (Mohd Saiful) has lodged a report and what he is looking for is justice. We must not forget him. We must carry out our responsibility so that Mohd Saiful’s claims are brought to court for a decision to be made in the name of justice. In this country, everyone is entitled to justice based on the rule of law."

But sir PM, Saiful is the complainant and he is entitled to justice based on the rule of law. But that is for those who were raped, sodomised without consent or by unlawful acts. Anwar is charged for consensual sex which means that the police and the attorney-general or solicitor-general must have concluded that both Anwar and Saiful had agreed to the sexual act albeit using the backside. So how is justice done when one party who had consented to do an act is accusing the other party of agreeing to act? I am perplexed and I am confused with our jurisprudence and the rule of law, dear PM.

Anwar's Consensual Sex; Saiful not Rape!

Home Minister Datuk Syed Hamid Albar, at a press conference nearby the court complex, said that Mohd Saiful Bukhari Azlan, is only a 23-year-old former male aide, should not be charged because he was the complainant.

Now I am beginning to learn a lot more things. Our laws are different from Common Law. Common law is meant for commoners but we are not so common and also lacks common sense.

Today's lesson: So long as you are the complainant you will not be charged for a crime.

Azizah quits Permatang Pauh today

News report from Malaysiakini:

Anwar Ibrahim announced today that he will contest a by-election for the Permatang Pauh parliamentary seat which will be vacated by his wife and PKR leader Dr Wan Azizah Wan Ismail.

Wan Azizah told a packed press conference this afternoon that she will be resigning as member of parliament for the seat but will retain her post as PKR president.

"I have submitted my resignation letter to the House speaker today," she said.

The Barisan Nasional will go wild now; they will mobilise everything and anything at their disposals to thwart any possibility of Anwar's comeback. Once Anwar is in Parliament then it would be more onerous to get him down. The nation will rock and be shaken to a new reality.

This is consistent with our goals towards securing a Parliamentary majority and forming a new government within this year.

Sworn Innocence or Sworn Guilt?

A Tale of a Murderer & Rapist.

Once upon a time, a murderer was charged for the murder of a politician. In the peoples' court he swore that he did not kill the man. The peoples' court decided to accept this sworn statement as swearing is accepted by the institution as a divine rule of truthful self-declaration. He died many years later.

When he met St. Peter at Hellcourt, St. Peter asked him: "Why did you swear that you didn't commit the crime when the truth is we know that you did? Do you know you would be sent to hell for lying?

The man replied: "Tell me, St. Peter, would a murderer be sent to hell after he died on earth?

St. Peter: "Yes, of course!"

The man asked another: "Tell me, St. Peter, will a liar be sent to hell for lying about his crime?"

St. Peter: "Yes, of course!"

The man asked again: "Tell me, St. Peter, would a murderer who told the truth and wouldn't lie to the earthly court, when he died, would he be sent to heaven for telling the truth?

St. Peter: "Definitely No! He is a murderer and he can be truthful but he remains a murderer and it would be injustice to the victim to have this murderer share the same place in heaven. He must be sent to hell for his crime."

The man asked again: "Tell me, St. Peter, is there two different hell - one for an honest murderer and one for a murderer who lied and who swear falsely?"

St. Peter: "There is only one hell and one set of rules for those in hell; all who are sent to hell have the same fate and punishment; they are all equal."

The man said to St. Peter: "I lived my last few years in a liberal world enjoying all the freedoms and pleasures of life. I know I would be punished when I come here, but at least I don't have to suffer my last few years in a jail."

A brother confessed to the court that he did rape his sister after watching porn. He was sent to jail. He should accordingly be sent to hell hereafter.

A girl alleged that her brother raped her in their parents' bedroom. If the boy is willing to swear that he did not commit the heinous act, will he be incarcerated or exonerated or exculpated?

Saiful lawyer Zamri Idrus said he Saiful is willing to publicly swear by the Quran soon that he was sodomized.

Zamri read Saiful's handwritten note which called on Anwar and the public to not interfere with police investigations into the matter.

In the three-paragraph note, Saiful, 23, also said he was waiting for the police to complete their investigations before he swear by the Quran.

Zamri said Saiful was also waiting for the police to wrap up their probe before doing so.

Zamri also revealed that Saiful is still motivated to seek justice.

Saiful just wants everyone to leave this case to the police. "Let the police investigate..." he pleaded.


Malaysiakini posed this question to Zamri: "We don't understand why you are holding this press conference?"


(It is uncommon for a sodomy victim to request for a press conference to plead to the public to leave everything to the police and it is puzzling that a victim who suffered a sexual crime would prefer to swear after the police had completed the investigation to the crime. What if the police say: "No case?" Does that mean he would use the Quran to testify to persist on such a crime? What if the police say there's sufficient evidence of a crime committed; the swearing becomes irrelevant unless the victim wants to confer something else that is metaphysical)

Experts: First medical report relevant


According to a medical expert, the police cannot ignore Dr Mohamed Osman's report especially if it conflicts with another medical examination done at the Hospital Kuala Lumpur (HKL) several hours later.

"Dr Mohamed Osman's observation showed no obvious physical evidence to support such a claim which could raise a reasonable doubt if the doctor in HKL observed the opposite...," said the doctor who has years of experience in handling rape and sodomy cases.

"Dr Mohamed Osman is experienced enough and couldn't be wrong not to notice the obvious signs like bruises, tenderness, swellings, scratch marks, fissure and bleeding per rectal and so on," said the doctor who requested anonymity.

"To associate tenesmus with sodomy, the complaint has to come after the event, and there would be evidence of injury to the anal mucosa like fissure or scar should be seen (to cause the pain) and there may be also some traces of blood seen."

But she said that since Saiful had alleged that he was sodomised two days before he was physically examined, it would be "almost impossible" to have any trace of material for DNA identification be available unless he used the same underwear that was not washed since the alleged event.

"There would be impossible also to find any recognisable material for DNA identification as well. Thus, asking for a fresh DNA sample is highly questionable because it is not a fresh sodomy/rape case where the evidence is still available."

Another medical expert told Malaysiakini that based on Mohamed Osman's medical report, Saiful had complained about being assaulted by a piece of plastic.

"There cannot be a charge of sodomy unless there is actual contact between the penis and anus. If an object was used, then the charge has to be assault," said the retired medical doctor who had carried out medical examination involving rape cases in a government hospital.
