Razak swears???

Abdul Razak Baginda insisted and maintained repeatedly, that, it is beyond any reasonable doubt, beyond any imagination, beyond any probability and beyond any intelligible comprehension, that Najib Abdul Razak and Rosmah can ever be involved in the Altantuya Shaariibuu murder case.

The only truth is that, it was the bloggers, who were spreading lies over the matter . As such, he pleads to the public to be apprehensive of what they read in blogs.

He said:

"I implore all of you and the public to stop spreading lies about Najib and his wife. I know Najib and his wife had never met the deceased, Altantuya.

"So much fitnah (slander) has been thrown against Najib and his wife. Those who have spread such lies can never produce any authentic evidence because there are none.

Asked to comment on why when he was charged in November 2006, his wife Mazlinda Makhzan (right) reportedly shouted hysterically "Why charged my husband, he does not want to be the prime minister" Abdul Razak replied that his wife was under duress then.

The truth is the truth? Why need to affirm in public if its the truth when truth is the truth and nothing can change the truth? Why the need to justify truth on behalf of the truth? Why need to hold a press conference to tell the truth when you can do so in that court of law?

Is truth a problem? Is Truth under threat? Are lies truth, or, truth are lies? That's the paradoxical truth!

Malaysia is too busy and unready for change!

The Anti-Corruption Agency had instructed PKNS acting general manager Low Siew Moi to go to its office yesterday. They wanted her to give information regarding the senior officers who had been receiving "allowances" from property developers on joint-venture schemes with PKNS.

That's probably the only reason why the senior officers were afraid of when they oppose the appointment of Low. She had 33 years of experiences in PKNS and 33 years of information relating to their conduct in relation to those allowances and profit-sharings. She may now become the crown witness.


Pempena Sdn Bhd, the investment arm of the Tourism Ministry, has more than 24 subsidiaries and most of them made losses over the last three years.

Pempana had invested RM54mil via equity participation and advances made to some companies and only seven of the investee companies is viable.

PricewaterhouseCoopers Capital Sdn Bhd (PwC), the firm hired to audit the companies recommended that some of the companies should be windup or liquidated or be disposed. It is also recommended that those investments with equity participants should be liquidated.

PwC noted that there were no clear defined investment policies and procedures on investment approach, setting of financial, tourism and operational KPIs and there is no structured plan. There is also no proper monitoring of investee Companies based on their shareholdings structure and lack of ability to influence decision-making.



ACA is also busy investigating Umno leaders allegedly involved in money politics.


Unrelated News!

Former Secretary-General of Rural Development Ministry Datuk Dr Abdul Aziz Muhamad was acquitted by the High Court for abetment in committing criminal breach of trust (CBT) and of cheating involving RM9mil.

Dr Abdul Aziz said he was glad that the Judge has been fair to him and he thank God for the wise decision of the Judiciary.

The Session Court had on Nov 16, 2005, convicted and jailed him for 5 years on each charges. Dr Abdul Aziz was convicted of abetting Ketengah GM Datuk Alwi Said in committing CBT and cheating the then Second Finance Minister Datuk Mustapa Mohamed by inducing him to believe that Ketengah's RM9mil investment in orchid cultivation, fish rearing and recreational facilities projects in Dungun was feasible.

God has been fair to him. God has also being fair to Najib. God would most likely be fair to PKNS senior management.

But God, what about Altantunya? Can we deemed it as fair too?

DIRTY: Politics or Politicians?

Najib admit that politics are dirty.

"I have to accept the fact that politics in this country has become dirty. There are certain quarters willing to do anything to achieve their aims."

We have to agree to his statement, holistically.

There can be no doubt about the dirtiness of our politics;

but it must also mean that the players who are themselves politicians must be dirty in order that politics can be dirty.

However, politics in itself cannot be dirty without money, damned monies, a lot of monies, and in order to fund the players of the dirty games the aspirers must be rich enough to pay the actors, the supporting casts and the crews and directors.


Meanwhile, in response to Balasubramaniam's withdrawal of the 1st Statutory Declaration and the subsequent submission of the 2nd SD, Najib said Balasubramaniam has no credibility.

I have to agree with Najib; it is clear that those who made the SD must be sure of what they wrote, the content must be truthful and factual; if at all it contains hearsay he must validate it and ensure that what is perceived and heard of must be the pure content without additives.

Update: Police also don't know Bala's whereabout

After making his second SD, Bala was escorted all day long until the evening.

He was accompanied home at 20:45hr, where security was taken care by a group of his friends who are PI and ex-officers of security forces.

It seems Bala's family had not seen him thereafter.

According to Tian Chua, Bala’s nephew, R. Kumaresan will be making a police report at Brickfields police station today at 17:00hr.

We just hope he is fine; someone just made a silly comment that Altantunya's ghost had invited him for a holiday; that's just silly. Nobody would be silly to use the same tools and technique again.

Update: 9pm

R. Kumaresan, nephew of private investigator P. Balasubramaniam, lodged a police report in Brickfields here today over the disappearance of his uncle, aunt and their three children.

Kumaresan said it was unusual for calls to his uncle to go unanswered. He added that Balasubramaniam and his family had been incommunicado after the private investigator made a new statutory declaration, retracting his original statutory declaration on Friday.

Police are also searching for private investigator P. Balasubramaniam who has been missing.

Deputy Inspector-General of Police Tan Sri Ismail Omar said the police are eager to contact Balasubramaniam to assist in investigations into the two statutory declarations he made.

"We have no idea where he is and we appeal to anyone who knows of his whereabouts to contact us and this includes his lawyer who was last seen with him.

"We will be calling up several people to assist us to locate the private investigator," he said, quelling rumours that police had something to do with his sudden disappearance.

Ismail said Balasubramaniam's statement was vital if police wanted to get to the bottom of the allegations in his statutory declarations.

Bala SD corrections

Balasubramaniam woke up this morning and discovered that he made some mistakes in his earlier Statutory Declaration. He quickly got a new lawyer and immediately set out to make the necessary corrections and make his SD-II.

The following is the new statutory declaration released by P Balasubramanian today at a press conference in Kuala Lumpur.

I, Balasubramaniam Perumal, do solemnly and sincerely declare as follows:

4. I wish to retract all the statements that I have made in paragraphs 8, 25, 28, 49 and 50 to 52 of my statutory declaration dated July 1, 2008. The statements contained in paragraphs 8, 25, 28, 49 and 50 to 52 of my statutory declaration dated July 1, 2008 are inaccurate and not the truth. I wish to expressly state that:

a) At no material time did Abdul Razak Baginda inform me that he was introduced to Altantuya Shaariibuu by a VIP;

b) At no material time did Razak Baginda inform me that Najib Razak had a sexual relationship with Altantuya Shaariibuu and the she was susceptible to anal intercourse;

c) At no material time did Abdul Razak Baginda inform me that Najib Razak instructed Abdul Razak Baginda to look after Altantuya Shaariibuu as he did not want her to harass him since he was the deputy prime minister;

d) At no material time did Razak Baginda and/or Altantuya Shaariibuu inform me that Najib Razak, together with Abdul Razak Baginda and Altantuya Shaariibuu had met and all been together at a dinner in Paris;

e) At no material time did Altantuya Shaariibuu inform me that she wanted money in the sum of US$500,000 as a commission for a submarine deal she assisted with in Paris;

f) At no time whatsoever did Abdul Razak Baginda and/or Altantuya Shaariibuu inform me that Najib Razak met with Altantuya Shaariibuu in Singapore;

g) At no time whatsoever did Altantuya Shaariibuu inform me that she wanted me to arrange to see Najib Razak;

h) At no time did I tell the police during the course of their investigations about any relationship between Najib Razak and Altantuya Shaariibuu as no such relationship existed to my knowledge. Accordingly, the statement I signed before the police is complete;

i) At no time did Abdul Razak Baginda inform me that he had sent Najib Razak an SMS the evening before he was arrested; and

j) At no time did Abdul Razak Baginda inform me that Najib Razak had sent him an SMS on the day of his arrest to the effect that he was going to see the IGP that day and that the matter should be resolved and for Abdul Razak Baginda to remain calm.

5. In addition, I wish to retract the entire contents of my statutory declaration dated July 1, 2008. I was compelled to affirm the said statutory declaration dated July 1, 2008 under duress.

And I make this solemn declaration voluntarily and conscientiously believing the same to be true, and by virtue of the provisions of the Statutory Declarations Act 1960.

Bala said: "I wish to retract the first declaration. I was compelled to affirm the July 1 declaration under duress."

He however did not reveal who forced him to affirm the first declaration.

Bala's former lawyer, Americk Sidhu, who was with him yesterday was unaware of the latest development.

Americk told Malaysiakini that Balasubramaniam received a phone call from the police soon after his press conference yesterday to report to the Brickfields police station.

Americk Sidhu said that he last saw Balasubramaniam at 4.45pm after dropping off his client at the police station.

So, everything is now clarified; Najib had nothing to do with the whole Altantunya episode; it was merely a bad dream, some kind of a neurotic disorder, something which we often called insane delusion, which affects his mind at that particular time and of which had cause him to pre-assumed/perceived some phenomena which did not exist; and of which he was not able to discern and have no control over his mind.

Now that he had fully recovered, he would want to correct the wrong and make it right; so that the right would not be wronged, and permits the wrong to be the right.

Now we all can see clearly the difference between the right and wrong. The wrong is now righted and the earlier right is now pronounced to bewrong.

But it does cause some uncertainty when the certainty is clarified, that we can neither see which is right nor what is wrong; and neither can we now understand the right from the wrong; for the right had displaced the wrong, and the wrong from the right, such that the right becomes wrong, and the wrong now righted in such way that the right can also be wrong, while the wrong is now called right.

It is now clear that there can be no right or wrong, for wrong can be perceived to be right and the right had been perceived as wrong. We can fully understand the right and the wrong as long as the wrong is made to be wrong and the right is declared as right.

Right or wrong? Can you tell me, please?

Najib admitted he had meeting with Saiful

Deputy Prime Minister Najib Abdul Razak today admitted that he met Saiful Bukhari Azlan a few days before the latter lodged a police report against Anwar Ibrahim for alleged sodomy.

The admission by the deputy premier today was a shocker as previously he had acknowledged Saiful meeting his special officer three months ago to seek government scholarship.

At the time, he did not disclose about this personal meeting with Saiful.

"There are two elements. He (Saiful) came to the office to seek help for scholarship and he only met with my special officer.

"He (also) came to my house because he needed help because he was so traumatised, so that was it.

"He just came for help, that's all and he never met me when he came to my office," said the deputy premier.

Najib revealed the meeting when asked by reporters on his views behind Anwar's continuous attacks against him.

"I don't know, maybe he (Anwar) thinks I am the one behind the guy (Saiful). Actually there is no conspiracy, he came and saw me to complain that he had been sodomised by Anwar," said Najib.

Najib added he accepted the meeting with Saiful in his capacity as a government leader and the young man as a Malaysian citizen.

With his ‘revelation', Najib was pressed by reporters for more details on their meeting, including whether he believed the claims made by Saiful on the alleged sodomy.

In this, Najib said: "I was sceptical, I was not sure whether there was any basis or whether it was genuine or whatever it was. I was worried, so I said ‘look, it's up to you (to decide on the next course of action)."

But he also added that Saiful "looks genuine".

"I don't dare to say. He looks genuine as he was in fear, his hands were seram sejuk (cold) but I dare not draw a conclusion, I advised him that 'you decide for yourself'," said Najib.

Do you consider that he did not tell the truth earlier? or, he hid the truth? or, he forgot? Oh, it was half of the truth; but he did tell the truth! I think he forgotten about it. He just remembered today after his special adviser reminded him that he met up with Saiful in his house, and not in the office.

The following is an excerpt of the statutory declaration sign by Abdul Razak Baginda's private investigor P Balasubramaniam on July 1:

14. Altantuya had introduced herself to Suras as ‘Aminah’ and had informed Suras she was there to see her boyfriend Abdul Razak Baginda.

25. During this discussion and in an attempt to persuade me to continue my employment with him, Abdul Razak Baginda informed me that:

1) He had been introduced to Aminah by Najib Razak at a diamond exhibition in Singapore.

2) Najib Razak informed Abdul Razak Baginda that he had a sexual relationship with Aminah and that she was susceptible to anal intercourse.

28. Whist I was talking to Aminah, she informed me of the following:

1) That she met Abdul Razak Baginda in Singapore with Najib Razak.
2) That she had also met Abdul Razak Baginda and Najib Razak at a dinner in Paris.

3) That she was promised a sum of US$500,000.00 as commission for assisting in a submarine deal in Paris.

7) That if I wouldn’t allow her to see Abdul Razak Baginda, would I be able to arrange for her to see Najib Razak.

Private investigator P Balasubramaniam has made shocking claims that Deputy Prime Minister Najib Abdul Razak had links with murdered Mongolian Altantuya Shaariibuu.

He also revealed that Najib had also informed his close associate Abdul Razak Baginda that inspector-general of police Musa Hassan would 'take care' of the murder case which implicated the accused.

And he further revealed that his evidence in his police statement linking Najib to the case was recorded by the cops in a move to protect the DPM.

These revelations were made by Balasubramaniam in a statutory declaration which he filed two days ago.

He was the PI hired by Abdul Razak to handle Altantuya, who had apparently come over to Malaysia in 2006 to settle some issues with Abdul Razak.

In the statutory declaration, Balasubramaniam said that he was told by Abdul Razak on Najib's links with Altantuya.

He also revealed that Abdul Razak had SMSed Najib on the day he was arrested over Altantuya's killing and had received a reply from Najib which stated that he had spoken to the IGP.

Balasubramaniam said that in his reply, Najib had told Abdul Razak that the matter would be taken care of by the IGP.

The PI also revealed that he had informed all of these to the police when they took his statement but was surprised that all mention of Najib was removed from the statement.

P. Balasubramaniam, the private investigator hired by Razak Baginda to keep Altantuya away from him, has signed a statutory declaration which basically shows Deputy Prime Minister Datuk Seri Najib Razak's alleged involvement in the case. He swears to seeing an SMS from Najib to Razak on the day he was arrested which said: "I am seeing IGP at 11am today… matter will be solved… be cool."

DPM 's office & Scholarship application conundrum

Deputy Prime Minister Najib Abdul Razak today strongly dismissed claims that he was involved in a conspiracy to ruin PKR leader Anwar Ibrahim's political career.

"I am not behind this. The most important thing (now) is whether the act (sodomy) took place. That is for the police to establish," he told a press conference at the Parliament lobby today.

Najib today denied that Saiful was an undercover agent for him at Anwar's office. He said that photo was taken was taken when the 23-year-old Saiful came to his office three months ago.

"It was taken three months ago when he came to seek a government scholarship to pursue his studies as he (Saiful) is a student leader," explained Najib.

If Saiful who has a CGPA of 0.8 needs scholarship, he should normally apply to PSD which is the appropriate body; he could seek someone who had strong connection with ministers to get it through the back door. Anwar is not a minister in the Barisan controlled government and thus there's no back door advantage unless it's not about advantage but funtime.

Why did Saiful go to the DPM's office to seek a government's scholarship and how is it that he was treated so well by the special officer?

Could all of you students who need scholarships to pursue further studies please go to Najib's DPM office to apply and see whether the officers there, in particular, Najib's special officer Khairil Anas Yusof, would be so extremely gracious as to grant you an audience? By the way, Saiful's CGPA in Uniten was 0.8 and 1.0 as admitted by him at riwayathayat.blogspot.com

So, it must mean that any aspiring students with CGPA of 1.6 down to 0.8 can seek the DPM's office for scholarships. The irony is that many students with CGPA of more than 3.0 and above were rejected outright and even those with CGPA of 3.8 to 4.0 were not granted scholarships.

The reason of scholarship visitation by a student to a deputy prime minister's office sounds frivolous, preposterous and quixotical unless we are all characteristically credulous.

Raja Petra: 'Rosmah at murder scene'

Raja Petra Kamarudin made a statutory declaration alleging that Deputy Prime Minister Najib's wife Rosmah was at the murder scene of Mongolian Altantuya.

"This is a very mind-boggling statutory declaration," Najib's press secretary Tengku Sarifuddin Tengku Ahmad told Malaysiakini.

According to the two-page statutory declaration, three other people were also present at the scene of crime.

In the SD, Raja Petra named the two other individuals as one acting colonel Aziz Buyong, who is described as ‘a C4 expert’ and the latter’s wife, known only as Norhayati, who is also said to be Rosmah’s aide de camp.

"My informer states that Aziz was the person who placed the C4 on various parts of Altantuya’s body witnessed by Rosmah and Norhayati," Raja Petra claimed in the document.

RPK further alleged that he has also been ‘reliably informed’ that Prime Minister Abdullah Ahmad Badawi knows of Najib's wife alleged involvement.

"[...] Abdullah has received a written report from military intelligence confirming what I have revealed and this report was subsequently handed over to his son-in-law Khairy Jamaluddin for safekeeping," he said.

Apart from Abdullah and Khairy, Raja Petra claimed "one of the (Malay) Rulers" has also been briefed about the matter and is fully aware of the allegation.

He said he has agreed not to reveal their names other than mention that the prime minister and his son-in-law have been given a copy of the military intelligence’s report.

Raja Petra accompany Razak Baginda in Sg Buloh

True to his anticipation and conviction, Raja Petra Kamarudin landed and registered as a member of the Sungei Buloh jail today. Here, he should have the companionship of Abdul Razak Baginda who had resided there for quite some time. Raja must have been looking forward for this trip there.

Raja Petra's wife Marina Lee Abdullah was present in the court today and expressed her shock over her husband's decision not to post bail.

"This is a statement he wants to make. He feels that he has done nothing wrong and we don't have the funds."

Malaysia-Today launched a campaign to request for a RM1 donation from readers and sympathizers so as to raise RM5,000 to assist the bail sum. However, by 4pm this same day the donation received amounted to about RM35,000 with contributions coming from all over the world.

Immediately Raja Petra's wife called off and stopped the campaign as she makes it known that she only needed RM5,000 and that it is RPK's principle that collecting excesses would not be appreciated; that the excess amount collected would be given to charity.

Observing the support from everywhere and the concerns expressed I think it is an unwise move to indict RPK for a criminal offence instead of challenging him in the civil court under defamation law.

This unwise action would in fact garner stronger and bigger support from national and international institutions and individuals who would moved to take sides of the blogger king and give Pakatan Rakyat a better leverage and caused greater discontentment and frustrations against the ruling regime and the legal system administrators.

In the words of Francis Bacon, libels and licentious discourse against the state, when they are frequent and open; and in like sort, true and false news often running up and down to the disadvantage of the state, and hastily embraced; are amongst the signs of trouble.

If that come to that, that the best actions of a state, and the most plausible, are taken in ill sense and traduced; for that shows the envy great, as Tacitus saith: conflata magna invidia, seu bene sen male gesta premunt [when dislike prevails against the government, good action and bad offend alike].

Neither does it follow, that because these fames are a sign of troubles that the suppressing of them with too much severity should be a remedy of troubles; and the going about to stop them do but make a wonder long-lived.

As Machiavelli noted, when princes, that ought to be common parents, makes themselves as a party, and lean to a side, it is as a boat that is overthrown by uneven weight on the one side.

Also, when discords and quarrels, and factions are carried openly and audaciously, it is a sign the reverence of government is lost.

So when any of the four pillars of government (which are religion, justice, counsel, and treasure) are mainly shaken or weakened, men had need to pray for fair weather.

Concerning the materials of seditions, the surest way to prevent seditions is to take away the matter of them. For if there be fuel prepared, it is hard to tell whence the sparks shall come that set it on fire. The matter of seditions is of two kinds: much poverty and much discontentment.

For discontentments are most dangerous where the fear is greater than the feeling. Besides, in great oppressions, the same things that provoke the patience, do withal confound the courage; but in fears it is not so.

It is true that every vapor or fume doth not turn into a storm; however, it is nevertheless true that storms though they blow over divers times, yet may fall at last; and as the Spanish proverb noted well, "the cord breaketh at the last by the weakest pull".

Common people are normally of slow motion, if they be not excited by the greater sort; and the greater sort are of small strength, except the multitude be apt and ready to move of themselves. This is the danger: when the greater sort do but wait for the troubling of the waters amongst the meaner, that then they may declare themselves.

Tacitus saith: "Atque is habitus animorum fuit, ut pessimum facinus auderent pauci, plures vellent, omnes paterentur" [A few were in a humor to attempt mischief, more to desire, all to allow it].

The remedy is surely going to be worse than the disease, a wise man saith.

Raja Petra: A Prisoner-in-Waiting

I read with sadness and pride of the words of Raja Petra Kamarudin on his impending arrest and indictment. This is what he had to say to his readers:

I received a phone call early this morning saying that the police have contacted YB William Leong to inform him they will be taking me in today. It was not made clear whether it would be to take my statement, which they failed to get from me last Friday, or whether I am to be detained or charged. Nevertheless, I am on standby, waiting for them to phone me to ‘surrender’ myself to Bukit Aman, or for them to come to my house to arrest me. Either way I am waiting and am quite prepared for the prospect that this may be my last article for quite some time to come.

Whatever it may be, one thing is very clear in my mind. This is God’s will and if I am to suffer a fate of long detention then this is what God has willed for me. And I will submit to God’s will for does not Islam mean submission?

Yes, Islam is not about rituals. Islam is not about ‘showing’ you are a true Muslim by performing rituals. Islam is about submission and there can be no submission unless you are able to and prepared to submit to God’s will. Not doing so would mean that you have no submission in your heart and therefore would not be a Muslim at heart.

Thus far I have only mentioned fardu ain, the rituals that a Muslim needs to perform. But Islam is more than just fardu ain. There is another fardu called fardu kifayah. And fardu kifayah is mandatory upon all Muslims. But fardu kifayah is not about rituals. It is about doing your duty to the community. And one of the most important tasks a Muslim must perform for his community is to oppose all forms of evil or kemunkaran.

And that is what I perform under the mandatory fardu kifayah. I oppose evil. But the government calls it sedition. And for my ‘crime’ of sedition they would like to send me to jail. I would not like to go to jail for grabbing the backside of a cigar girl. I would not like to go to jail for raping an underage girl. I would not like to go to jail for murdering a Mongolian woman. I would not like to go to jail for robbing the nation. But I would enjoy going to jail for fulfilling my duty as a true Muslim under the mandatory fardu kifayah. So I await jail with glee in my heart.

So I await the arrival of the police or for the phone call for me to come surrender myself to Bukit Aman. And when that happens I will do what is required of me and not question God’s wisdom. Why did Rowena binti Abdul Razak Baginda cried so loud and pleaded to her father: "It's suicide, father. It's stupid" after Razak Baginda whispered something to his wife and daughter?

Did he tell them that he is going to plead guilty so that all is well for what goes well?

Or, was he so stressed out by the crisis?

By the way, Pak Lah was bestowed another honorary doctorate yesterday by the Moscow state institute. Congratulations Mr. PM.

Altantunya case: Motive alone isn't sufficient

The prosecution said they would prove the affair between Razak and Altantunya and that there was a conspiracy.

It seems the DPP is trying to establish motive and conspiracy as the elements of homicide.

Murder is defined as an unlawful killing of a human being in the King’s peace with malicious aforethought. Motive for killing alone is insufficient to constitute an act of homicide. The Actus Reus for murder is unlawful killing. The prosecution must prove that the act is voluntary (R v Bratty), AND it must be factual and legal cause of death (R v White). The legal cause must be substantive and operative (R v Cheshire) and the cause of death operates unless it is broken by an intervening Act (R v Smith).

The prosecution therefore, must establish beyond reasonable doubt that the accused had the necessary Actus Reus (the act that caused the death) and the necessary Mens Rea (the intention to kill), and that the act was the factual cause of her death in the absence of any notus actus intervenien (intervening events).

DPP Majid said evidence would be adduced to show that Altantunya's death was caused by "probably blast-related injuries" of being blown up alive.

In fact this would make the additional prove of causation harder as the prosecution would now have to establish that she was not killed before she was blasted, which means, the prosecution must now proved with evidence that she was alive prior to the blast that killed her. Secondly, the DPP would now also have to prove that the accused had conspired with others to order the blasting that was the factual caused of the death. Since the accused was not at the scene of the killing, then the prosecution had to established that there was factual evidence that the accused had instructed the blasting that killed her. In the event that there are evidence that she had already died before the blast, then the accused here would not be guilty for the killing. As an example, if there is evidence that the killer had only instructed the killing by way of using a knife, then the use of explosive would be insufficient to constitute an act of murder.

It was reported that the DPP is trying to establish that the accused had planned the murder.

In criminal law, Actus Reus and Mens Rea are the necessary ingredients of a crime of murder. It must be proved. Then, it must be also proved that the act was the factual cause of the death (that is, there is no intervening events).

Voluntary Unlawful killing - The actus reus required evidence that the unlawful killing of a human being was voluntary. (Bratty v AG for Northern Ireland (1963). Lord Denning in Bratty stated that the requirement of the act to be voluntary is essential, not only in a murder case but in every criminal case. It must be proved that the accused consciously willed that conduct.

The prosecution need to prove that the accused had intentionally did an unlawful and dangerous act which inadvertently caused the victim’s death (Newbury and Jones). The unlawful and dangerous act must be positive and must have caused death (Cheshire).

Factual & Legal cause of death - The prosecution must also proved that the act was a factual and legal cause of the Victim’s death. In R v White (1910), the accused intentionally put cyanide in his mother’s drink to kill her but however, the mother died of heart attack instead. Legal cause must be a substantial and operative cause of the Victim’s death. In Cheshire (1991) CA, Beldam LJ said that the act must be more than insignificant and that the accused could not be exculpated even if medical negligent was the immediate cause of the Victim's death.

Novus actus interveniens - The cause must operates unless it is broken by an intervening act, Novus actus interveniens, In Smith (1959), it is held that unless the second cause is so overwhelming as to make the original wound merely part of the history, the first cause still operates. In Blaue (1975) CA, the victim, a Jehovah Witnesses, refused blood transfusion that would have probably saved her life, later died of blood loss. Accused was guilty of manslaughter, Lawton LJ said that people who has apply violence on other people must take their victim as they finds them (Thin Skull Rule), not only their physical condition but also their religious beliefs. Similarly in the case of Holland (1841), the victim neglected to treat his wounded finger which in turn resulted in a lock- jaw, and he died. The accused was guilty of murder.

Apart from the actus reus, the prosecution must also proved beyond reasonable doubt that the accused had the necessary Mens Rea, which is the intention to cause death or to cause grievous bodily harm. The mens rea requirement for murder is malicious intention to cause death or grievous bodily harm (R v Moloney). Grievous bodily harm means serious bodily harm: Smith.


The mens rea required is intention to commit the act and not intention to kill or cause grievous bodily harm (Newbury and Jones).

The judge is not bound by law to infer intent or foresight. It must be a natural and probable consequence – shall decide whether there is intention or foresee that result.

In the current case, the accused could be charged for the offence of conspiracy. If convicted, they would be guilty of conspiracy to commit the substantive offence or offences in question. The sentence would follow the same punishment as in the substantive offence.

Conspiracy is defined as:

‘If a person agrees with any other person or persons that a course of conduct shall be pursued which, if the agreement is carried out in accordance with their intentions, either –

a) will be necessarily amount to or involve the commission of any offence or offences by one or more parties to the agreement, or

b) would do so but for the existence of facts which render the commission of the offence or any offence impossible,

he is guilty of conspiracy to commit the offence or offences in question.

The actus reus in conspiracy consists of an agreement between the parties on a course of conduct that will necessarily amount to the commission of any offence.

An agreement may be expressed or implied and is complete as soon as the parties agree. The conspiracy must be communicated between the parties who should intend that the agreement be carried out.

Parties to an agreement to commit a crime can be between two or more people. Where more than two are involved, it is not necessary for them all to agree together. The agreement can take the form of a ‘chain’ provided that all concerned have a common purpose relating to the commission of the offence.

The course of conduct that shall be pursued includes that the parties intended to act or intended the consequences of the act.

Mens rea to be proved is intention to pursue a criminal course of conduct. Recklessness is not sufficient. Since intention is the only mens rea, there is only conspiracy to commit murder.

Jig-Saw Puzzle of Abdul Razak Baginda

Why did Razak made so much confession when he actually didn't need to?

At this moment, he was in this court to apply for bail. The court is only to hear the reasons why bail should be granted for an accused charged for a crime for murder, which is unbailable unless under exceptional circumstances . All that was required is that his lawyer is to submit justification and documentary evidence in support of his application for bail. The court would only consider it's justifiability if the accused submit his affidavit based on the defence of NECESSITY, and often on grounds of incapacitation or other medical reasons. His lawyer knows that and should have gathered such testimony and medical justification in order to convinced the judge to grant bail.

Instead, they choose to reveal so much information about himself and those implicated in the said case which is not directly related to the application. When Razak’s counsel Wong Kian Kheong stood up before Judge Segara to make the application for bail, he look straight at Justice Segara and said:

"I’m taking an unprecedented step. I’m presenting Abdul Razak’s affidavit."

Segara quickly cautioned Wong to think of the wide implications of this move. Unperturbed, Wong started reading Abdul Razak’s affidavit, outlining the events before and after the death of the Mongolian woman.

Razak acknowledged that he had met Altantuya in Hong Kong at the end of 2004, in Shanghai Kuala Lumpur and France in 2005 during their affair, which lasted about eight months.

Razak chronicled his love story with Altantunya, which he referred to her as Mina.

“I have given her money several times, US$10,000 three to four times or more. I stopped giving because I could not stand the harassment.”

Razak said he then sought legal advice and was told to hire a private investigator to protect his family.

He duly employed P. Balasubramaniam. He later sought out DSP Musa Safri, whom he had befriended through his work at the Malaysian Strategic Research Centre. Razak said he asked DSP Musa to get police to patrol near his house for security reasons and the DSP introduced him to Chief Inspector Azilah Hatri.

C/Insp Azilah called Razak and told him that he had killed six or more people before and therefore could help him stop the harassment.

“I told C/Insp Azilah not to do anything untoward against Altantuya. If any such thing were to happen to her, her family will look for me. I believe that as a police officer, he would not commit crime,” Razak said.

“I only asked him to get police to patrol around my house. I gave him my address and (that of) Hotel Malaya where the deceased was staying.”

Azilah and Corporal Sirul Azhar Umar have been charged with murdering Altuntaya.

Altantuya came to Abdul Razak’s house again on Oct 19 and a private investigator informed him that she was there. Abdul Razak then telephoned Azilah.

Wong said Azilah later told Abdul Razak: "Tonight, you can sleep in peace." ('malam ini encik boleh tidur nyenyak)

Razak admitted that he had met DSP Musa at the Deputy Prime Minister’s office and asked what happened to Altantuya but DSP Musa said C/Insp Azilah did not update him.

Judge Segara ruled there were no exceptional circumstances to allow bail as Abdul Razak did not submit a medical certificate despite claiming to be suffering from bronchitis.

Segara: "I can’t see any report unless I am blind. You will have an uphill task to convince me. There is no evidence he’s incapacitated due to his illness."

"I will not entertain even if Karpal Singh or the Mongolian government objects."

"There is also no dispute that the accused, on face value, abetted in the crime," he said, adding that Abdul Razak and Azilah were in constant communication before Altantuya was killed.

The judge said Altantuya had gone to Abdul Razak’s house on Oct 19 and stopped in front of his house. He said there had been no necessity to arrest her.

"Azilah was not acting as a police officer in his dealings with Abdul Razak," Segara concluded, adding that Abdul Razak did not sever ties despite the policeman boasting of killing six or seven people.

The judge also chided Abdul Razak for dragging the name of the deputy prime minister into the picture.

Segara: "He should not have created an embarrassing situation for the DPM. He should have gone to the IGP. If the victim had indeed blackmailed him, she would have been charged and by now would have been sent back home. She would not have died."

Razak was originally represented by Lawyer Datuk Muhammad Shafee Abdullah, a renown criminal expert who often represented clients who are high profile and wealthy. However, Razak later change his counsel to the current Wong Kian Kheong.

No reasons had been published publicly but outsiders are propagating a "catch22" situation. I am just as puzzled, and far more puzzled now, with this testimony at the court. Hollywood may be interested in this story line.

We are not allowed to present our personal hypothetical views as it would constitute subjudice and a contempt of court. The public are to accept the testimony in the proceedings.
