Perak in deep shit again! Nizar declared as rightful MB

The High Court declared today that Nizar is the rightful and legitimate Menteri Besar of Perak.

Judge Datuk Abdul Aziz Abdul Rahim said in his ruling: “The only way to force the MB to resign is through a vote of no confidence that must be taken in the state legislative assembly.”

The court, which issued a declaratory relief that Datuk Dr Zambry Abd Kadir had no rights to occupy the office of Perak Mentri Besar, also ordered him to show cause and give information under what policy, power or authority he allegedly held office and exercised the responsibilities, functions and duties as Mentri Besar.

The High Court also rejected an appeal from Barisan Nasional’s (BN) Datuk Zambry Abdul Kadir for a stay of the declaration.

The court also granted an injunction to prevent Dr Zambry or his agents from acting or implementing the responsibilities, functions and duties of Perak Mentri Besar.

On Perak Legal Adviser Datuk Ahmad Kamal Md Shahid’s claim that he was a neutral party in the proceedings, the judge said that Ahmad Kamal “had not applied his independent mind”, adding that to an extent, his evidence was “coloured” as he admitted to taking instructions from Dr Zambry’s lawyer when he was cross-examined on his affidavit.

“He is a very senior legal officer but he chose to use the word instructed instead of request or volunteered,” he said.


What happens now?

The decision by the High Court is deemed final and effective until an appeal is granted at the appellate court which may be too late if the Sultan do agree with the dissolution of the state assembly.

Nizar will seek an audience with the Sultan and seek His Highness consent to dissolve the state assembly.

Do Zambry have any alternative to stay in power? No, not really, unless the Federal Govt declares a state of emergency.

On what basis Nizar can intelligently articulate for the request of dissolution?

PR has lost its ball, it give away 3 ADUNs to BN and hence lost the majority.

Is Nizar that naive that he does not know this simple arithmetics!

Same as in business entity, you need to have that majority control of 50% plus one share to be in control and have authrority to deal with transactions.

Sorry, PR has failed terribly in Perak but that have been successful in buying time and deflect their internal problem/shortcomings to BN/Sultan etc.

This High Court decision is in fact a way for BN to legalise the appointment of MB.

PR must deal with your internal problems and shortcoming for the last 12 months in power for those state they are ruling or else, you will be voted out. Go ask itself why it lost the 3 ADUNs in the first place.

Bermula dari 5 Febuari 2009, jumlah ADUN UMNO 27, jumlah ADUN DAP 17. PKR 5, PAS 6, MCA 1 dan 3 ADUN Bebas.

Itu pun dah cukup terang dan jelas akan 'suara rakyat' dan siapa yang sepatutnya menjadi Menteri Besar. Walaupun aku bukan orang UMNO tapi aku tak mudah ditipu oleh fahaman anwarisma wal juburi!!

Oleh kerana MCA berada di dalam Barisan Nasional, maka jumlah kerusi BN ialah 28 orang dan 3 ADUN bebas telah membuat pengakuan di hadapan Paduka Seri Sultan Perak bawa mereka bertiga memberikan sokongan kepada BN, menyebabkan kekuatan BN ialah 31 sedangkan Pakatan Rakyat ialah 28.

Bodoh sangatkah Paduka Seri Sultan Perak untuk membubarkan DUN? Ajaran demokrasi barat mengajarkan bahawa kelebihan satu undi juga dikira majoriti, jadi atas alasan apakah Nizar minta DUN dibubarkan? Siapakah Nizar dalam PR yang menjawat kedudukan yang sepatutnya disandang oleh Ngeh atau Nga?

Fahaman anwarisma al juburi membenarkan amalan lompat parti dan disokong oleh Mursyidul Am PAS setelah dijangkati oleh virus Erdogan kecuali Kapal Karam memandang kerja itu jijik dan hina.

Kalaulah pada 16 Sept 2008, berlaku lompatan oleh 30 ekor katak dari BN ke PR, sudah tentu kamu akan menyanjung dan mendewakan katak katak itu. Apakah kamu akan mengatakan berlakunya 'rampasan kuasa' sekiranya al juburi berjaya memenangi sokongan majoriti Ahli Parlimen untuk menjadi Perdana Menteri, walapun dengan kelebihan 1 kerusi??

Jahat sungguh wabak presepsi yang disebarkan oleh virus A1N1 (Anwar Ibrahim Nombor 1) yang berpunca dari BABI (Brother Anwar Bin Ibrahim) yang bertopeng manusia.

The probem is DAP and PAS have said something favourable about working with BN to solve the Perak situation.

Even Anwar has said something similar before the court verdict.

Was that a back-up in case Bn finally wins this case?

I am sure, BN will go all out to woo only PAS and realise the dream of the 'ketuanan' supremacy at the expense of DAP and PKR.

Pakatan guys better be more assertive instead of falling into such traps.

Ever notice how BN/UMNO has been praising PAS of late while whacking away DAP and PKR?

They (BN) have not given up. They are trying to still get PAS to break away from PR coalition.

democracy constitution and legislation are not simple capitalism majority shareholder own the day games. Even for public listed company, there is restriction and regulation to protect some right of minor shareholder to sustain the trust. Otherwise, the public share listing system will collapse.

The company registrar lax the ruling on private company changing hand, as there is no much of public interest concern.

When come to state assembly, it is about concern of public interest. Because the Westminster system invent by the British, which already took 200+ years to strengthen individual virtue. Thus, frogs jumpship is never a problem because it is a political suicide to the "beneficial" faction.

When come to Malaysia, the politician virtue and the people awareness are low. Thus we see there is seize of power by froggies not once, but twice (Sabah and now Perak). Perak situation are serious because it happens after the state government has been formed. It is consider "dust settling", but alas, thanks for anwar, the frogs game start over again.

It is good time to "reboot" the Perak problem with a dissolution, because it has done collateral damage towards Najib administration and the monarch. You don't need a crystal ball to know that annihilated mca is bad for BN, e.g. somebody besides the taiko faction is needed to bare the blame of PKFZ scandals and others administration failure.

Initially said court to decide. Now court decided pulak want to say something else. The people who switched side does not reflect the rakyat's choice. Only choices for their own hide and pockets.

Fresh election is the best option. Retest the rakyat's decision. Not like many UMNO smart ass with their use of full armada.... now seem quite pointless.

if the court says the hoppers' letter of resignation are valid and 3 by-election will be held then maybe nizar got chance to stay as mb -lah. what is this ? this is just stalling until vote of no-confidence against nizar is tabled, and then nizar can say goodbye.

all thanks to perak dap leadership unable to control their goons (this is not the first time story, remember pokuan threaten to pull-out and resign and now the 2 cousins are aboslutely silence and let nizar running the show when they hold the most majority in the coalition)....

BN has lost all credibility because of the way they handled the Perak issue. This means that the further release of the ISA detainees is but a symbolic gesture. While we are happy about it, it does nothing, absolutely NOTHING, to improve the standing of BN in our perception.

As far as I am concerned, BN is still BUANG NAJIS.

(The Star) - Datuk Seri Dr Zambry Abd Kadir, whose nearly three-month tenure as mentri besar was ruled illegitimate by the Kuala Lumpur High Court on Monday, has likened himself to Nelson Mandela and Mahatma Gandhi.

Warning Pakatan Rakyat not to under-estimate him, he said the High Court’s “shocking decision” did not mean he would give up the fight.

“To me, losing the mentri besar post will not reduce my fighting spirit in upholding the truth.

If reinstated Mentri Besar Datuk Seri Mohammad Nizar Jamaluddin and his “friends ... assume that the High Court’s decision will dampen my spirit, then they have read me wrong,” he said in a blog entry early Tuesday morning.

He said a person did not need to hold a post in his struggle to uphold the truth, and likened the recent struggles faced by him and his “comrades from the Barisan Nasional” to those endured by politicians like Nelson Mandela and Mahatma Gandhi.

“Nelson Mandela sacrificed his freedom for 27 years in order to free South Africans from the grip of ‘apartheid.’

“Gandhi also sacrificed his life for the sake of India’s independence and so his people would be able to live without caste or religious boundaries,” he said.
