Stunned Jeff and Rocky's Bloop

Finally, after weeks of speculations, and first highlighted by Susan Sloone, Jeff and Rocky had publicly announced the impending litigation on defamation.

Jeff declared:

"The New Straits Times Press (Malaysia) Berhad, Kalimullah bin Masheerul Hassan, Hishamuddin bin Aun and Brendan John a/l John Pereira have jointly taken an order, via an ex-parte injunction obtained in the High Court of Malaya Kuala Lumpur (Civil Suit No. S6-23-3-2007) on January 11, 2007, against this blogger."

The above mentioned parties' application for an injunction has been fixed for a hearing at the same court on January 30, 2007 at 9.00am.

Jeff can only reveal what he intends to do:

"My lawyers are now taking care of it".

Of course, only lawyers can take care of it. What Jeff was afraid was subjudice.....


Similarly, Rocky announced in his blog:

"Unchartered waters. None of us have passed this way before, so I shall have to tread carefully."

"I have been served the papers. They dropped them on Tuesday evening, around 9.30 pm, at the National Press Club. They are applying for an injunction against Rocky's Bru, this blog. They are suing me for libel."


Susan called on fellow bloggers:

"Walk with Rocky & Jeff coz it ain’t over till it’s over"

Susan took the cue from kickdefella a.k.a Sheih who launched his latest poster “ROCKY We’re With You” taglined “It ain’t over till it’s over”. Earlier he dropped a hint “Watch Out for this space tonight”.

I had read those articles from both, I just can't figure the connotation of the elements which are libelous. However, I am not the authority to make the presumption.

Someone said to me: I just smell rats.... it's more to do with vengeance and settling a score...it's personal by observation." I couldn't agree nor to disagree. The battle of waterloo had to take place, someday and one day.

As a fellow blogger, and in the name of freedom of speech and expression, in accordance with the basic human rights, we Malaysians need to voice our deep concern of the observed situation and predicaments we are now facing. We could not have voted in a government to curb our human rights and to force us to succumb to arbitrary law or neither allow the system to rule by discretions which curtail the basic freedom as entrenched in the rule of law and natural justice.

Unless those words used composed elements of mala fide and with evil motive, critical comments and differences in ideology and disparities in political inclinations should be tolerated in order to preserve and promote an intelligible society that foster harmony and peace.

We are with you, Rocky and Jeff.

I had for the past weeks reluctant to include this tag logo, as it had been taken to connote defiance or anti-establishment.

But, with the current events happening, I could not sit and stay on the fence, watching the society been torn into pieces by the "powerful forces" within the oligarchy.

I just hope that the Prime Minister will open his eyes and see what his coterie are doing... Malaysia has never been far worse than it is, even in the days of Mahathir and the days when the judicial crisis erupted.

What we want to tell our beloved prime minister is that there is factual evidence that he had allowed his cronies to lead him by the nose, profiting personally for themselves at the expense of the society, and abusing and misusing his name to destroy the society at large. He just can't keep quiet and pretend that things are getting better...it is not, and the people, the rakyat are frustrated with what is happening. We need the prime minister to stamp his authority and crush his abusers within, the people who had formed an oligarch, the people who had betrayed the rakyat for self-gain.

Wake up, PM! We need you to protect us.

Of all the people, bloggers are sued by journalist & newspaper. Don't these people have anything as sue-able as those found in the blogs? Msia truly Asia!

I won't visit Msia anymore, at least not with my laptop in tow.

Libel law exists for a reason. My say, I don't think they should have sued, but if they (bloggers or not) commited libel then so be it (that is up to the courts to decide). Libel law covers not only bloggers, but papers as well.
