Two murder accused freed because of sloppy investigation

Two policemen accused of stealing firearms and ammunition from the police armoury were yesterday acquitted and discharged without their defence being called.


KUANTAN: A High Court judge here blew his top yesterday over the sloppiness of a police murder probe. In acquitting the two men charged with the murder in Lepar Hilir last year, judge Datuk Abd Halim Aman said he was baffled why the second accused was charged when there was no evidence that he had attacked the victim. He also took investigating officer, Assistant Superintendent Noorleyda Ahmad, to task for not conducting a thorough investigation. Abd Halim said Noorleyda had only done her job for the sake of "completing her task" (janji siap).


SEREMBAN: Six men, including two Customs officers, were freed by the Sessions Court yesterday after another "bungle" by the prosecution. The men, who were accused of robbing an Indonesian woman five years ago, were given a discharge not amounting to an acquittal following more than a dozen postponements to the case. At the last hearing on June 13, judge Allaudeen Ismail had warned the prosecution that he was allowing a final postponement as that was the first time the case was being mentioned before him. He had told prosecution officer Assistant Superintendent Mohd Fahmi Visuvanathan not to waste the chance to locate prosecution witnesses. In granting the discharge yesterday, Allaudeen said he had given more than enough time for the prosecution to locate the witnesses, including the complainant and robbery victim, Sujiy Tarham. You were given a second bite at the cherry but failed to use that opportunity. "Therefore, I have no choice but to give a discharge not amounting to an acquittal to all six accused."

KUALA TERENGGANU: Two policemen accused of stealing firearms and ammunition from the police armoury were yesterday acquitted and discharged without their defence being called. Sessions Court judge Zainal Azman Abdul Aziz said the prosecution had failed to establish a prima facie case against Constable S.M. Sathiya Silan, 23, from Port Dickson, Negri Sembilan, and Constable Akmal Aliff Mohammad, 21, from Pengkalan Hulu Perak. The two, who were attached to the General Operations Force, were charged with stealing the firearms and ammunition from the police armoury in Gong Badak in 2005. Also acquitted and discharged was ice factory supervisor G. Malaimaran, 23, who was accused of trading the firearms. Firearms of various types, along with two Styer magazines, 570 .38 Smith and Wesson and 26 9mm rounds, were stolen from the armoury at the 9th GOF battalion camp. In delivering his verdict, Zainal said the 50 prosecution witnesses had failed to link the three directly to the crime. The judge said the only points established by the prosecution were that Akmal’s fingerprints were found in the armoury, a gunny sack used to stash the firearms was bought by Sathiya Silan and the handwriting on a note found in the gunny sack had belonged to Malaimaran as did the marker pen used to write the note.

What has happened to our A-G's office and the quality and competency of our lawyers there?

I have heard people boasting about getting off the hook regardless of the crime committed as long as one have enough monkeys...err...money to spend. Maybe, they're not boasting after all. Were they?

our police look good at investigate and caught up the criminal but fail in court. they just leave unfinished job. sometime after nabbing the criminal they will hold press conference and proudly say the case is closed with this apprehend. is it really meant it?

The photo shows a typical malay penjual ubat (ali's cane included) calling passers-by with a gong. Perhaps this type of job better suits the sleepy old fella who likes holidaying/honeymooning overseas.

sorry mate. not enough time to do a proper investigation. need to spend more time and resources to investigate bloggers so that they cannot write and spread truths to the public. by the way, anything said by the bloggers which is contrary to the government's position is considered lies and untruth!

Prosecution problem or Lawyers' inefficient? And they PASSED the CLP, which is supposed to weed out dumbos like them from malpractising the legal system?!
