Justice can be Jousted



Watching this video at YouTube, we Malaysian must now wonder what sort of justice system we had all these years.

The only interesting fact is that, there was an Indian lawyer who said he is working very hard to assist a Malay Judge in scheming his career path, using the assistance of a Chinese Towkay, while concocting with a Royal Minister, manipulating a Mamak Prime Minister. This is truly Muhibbah!

Another point of interest is that this Indian lawyer advised the Malay judge to use the name of Allah, that is to say, he is leaving everything to Allah to ensure him the position of Chief Justice.

Coincidental or is it a success story, that man ultimately got what he had hope for, and the Indian lawyer must have been glad his effort did pay off.

However, what puzzles me is the fact that this judge had made a proposition that the English Common Law should be replaced by a Malaysian Common Law. So, what sort of Malaysian Common law do we have? The video did hypothetically suggest that Malaysian judicial decisions could be much influence and dictated by well-connected lawyers and rich entrepreneurs who had linkages to the political leaders whom were empowered to decide the career destination of judges and chief justices, and those aspiring judges would need to seek connectivity and favors from some lawyers and businessman.

If one day, the Parliament do decide to amend the Civil Law Act (Section 3) and repeal the Common Law and replaced it with a Malaysian Common law, I am not sure how the legal fraternity and the international jurist would view our law. We will not know what type and kind of rule of law will subsist in that system which is suppose to administer justice based on political patronages and directive. It sounds far scarier than the Nazi system of justice. Would we then need a new Gustav Radbruch's Formula?

I think we do need to have a lot more prayers for grace and guidance. We may also need to pray for peace and safety. Amen!

CJ's office will look into the video before commenting.
Nazri is unaware of the video coz he doesnt read Malaysiakini and he is awaiting to be briefed ( or directive from the 4th floor boys).
Its all quiet in the PM's front ( while awaiting for command from the 4th floor genuises).
You wonder why nobody ( from the establishment) dares to make a move at the moment.
Guys, good luck to you all if you have to face the cronies before these corrupt judges for justice.

On a side issue, we get to see how religion can be shamelessly manipulated by politicians.

I wonder how many politicians around the world are praying for the public gallery on advice from hindu/buddhist/christian/etc.

lari dari tajuk: saya baca di rocky's bru beliau tidak pernah mendaftar sebagai pengundi. ini bukan perkara 'terasing.' saya pasti ramai lagi 'bijak pandai' yang tidak mendaftar.. . contoh masa era anuar ibrahim ada satu prof jomo pun tak mendaftar sebagai pengundi. kamu orang2 yang konon 'elit' menyeru kepada 'jom sama2 tukar kerajaan sedia ada yang korup ini dsb.' sayang korang pandai cakap jer. asas untuk menukar pucuk pimpinan ialah melalui undi dan korang tak layak mengundi kerana tak mendaftar. kalo tak mendaftar baik tutup mulut jer. ini ialah tulisan saya kepada blog yang ke-lima. kalo awak tak pos kan tak per... itu hak kau.
