Functus Officio Balkis

Whose money is it?

Wives of Selangor Assemblymen and Mps or the Charity organization Balkis?

PKNS donated:

• RM218,719 for the opening ceremony of Komplex Wawasan Balkis;

• RM200,000 for the Balkis dinner;

• RM10,000 for a table at the same dinner; and

• RM161,660 for programmes organised by Balkis.

Total amount remaining in the accounts amounted to RM9.9mil.

Datin Seri Zahrah Kechik said she had the legal right to transfer the money anywhere she like as her husband was at the caretaker MB.

So, does a caretaker MB has the power and authority of an MB?

Does she knows what is "Functus Officio?

Which legal adviser told her she had the power and legal rights? Maybe, some kind lawyers should explain to her what is functus officio.

I don't think Datin Seri Zahrah Kechik consulted anyone. I saw the news on TV7 this evening. Apparently not even the auditors were consulted. The accounts for the previous year were also not presented yet. I get the impression she was running (maybe still is) Balkis like a sole proprietorship.

Probably her husband told her, "Semuanya OK!"

Lucky for malaysians the RM9.9million swindler was born Datin Seri Zahrah Kechik. If she was born Datin Seri Zahrah Besar, the amount swindled would had reached RM9.9billion

Intended expenses cost less than a single dinner and RM10m in the account! This is way worse than spore's NKF saga.

RM10k dinner table got extra service or not? No nightclub charge at that rate leh.

An organization is a separate legal entity, and that includes a charitable organization.

Thus, each organization is governed by its own constitution and by the Societies Act and Companies Act.

Withdrawing or removing monies from an organization without proper authorization and which contravenes the company's constitution is a breach of trust and criminal in nature.

She should brace herself to be indicted.

This Balkis is a charitable organization and the officers have fiduciary duties. They would not have the power or authority of simple companies or Sdn Bhd. It's a charitable org and are governed by strict nature of the laws.
